Chair: Denise Brett SC

Speaker & Topic:

Matthew Holmes BL - How World War II brought the first deportation case to Ireland?

This breakfast briefing webinar will discuss the historical and legal significance of the State (Goertz) v Minister for Justice [1948] IR 45 – a case where a German spy parachuted himself unauthorised into Ireland contrary to the Aliens Order, 1935. He remained at large until his arrest in August 1946 when a deportation order was then served on him. His challenge to the legality of the deportation order and Habeas Corpus was ultimately considered by the Supreme Court in April 1947. This case offers an interesting comparison to the current law on deportation today.

Matthew will be delivering a detailed paper after his talk which provides the most up to date review of the law on deportation.
